Terms and Conditions of Cattle, Horse, & Other
Livestock Auctions:
Any announcements from the "Auction Block" will take precedence over those printed below.

Seller Representation:

We tell you what the seller
tell us regarding exposure dates, bulls exposed to,
past vaccinations, age, temperament, etc.; and we make no
warrantee regarding
the accuracy of that information - bidding on the animals
indicates you have satisfied
yourself as to all aspects of the animal and no one else
is responsible.

In the case of purebred
cattle, the animal is represented by the seller as to
pedigree and
tattoo, and all other information from 1. above - any
further dispute is between buyer & seller.

Veterinarian Inspection:
-
Pregnancy Testing: We
publish or announce from the block the name of the vet and
his/her opinion of the length of pregnancy and that the
animal is believed to be safe
"in calf" on the day of testing (usually the day
before the auction).
Accuracy: Many will tell you that their vet is very
accurate, but no vet will tell you
that they can accurately determine the length of pregnancy
when pregnancy is advanced
beyond 120 days. The fact is, that after 3-4 months
of pregnancy, the accuracy diminishes
greatly, and variations of one month or more in either direction
are common. Use the vet's
opinion
of length of pregnancy in addition to exposure dates, and
watch the cattle for signs of
oncoming calving. Many cows can vary by up to 2
weeks in earlier or later from their
actual due date.

Semen Testing of
Bulls: In most cases, the semen testing of bulls has
been done prior to
arrival at the auction yard, and any bulls selling as
"semen tested satisfactory" will have a vet
certificate
identifying the bull and the results of the test and the
date of the test.

Buyer Obligations:

Buyers are required to pay
for any purchases of livestock on the day of the
auction. Those
buyers using a credit facility such as a Breeder/Feeder
Association, FCC, Chartered Bank, or
Credit Union must have a letter of authorization or purchase order
indicating the maximum
amount
to be purchased (and any other conditions required by the
creditor) faxed to Johnstone
Auction Mart Ltd. at least 24 hours prior to the
auction. If the cattle must be branded with
the creditor's brand, we prefer the branding be done at
our facility before leaving.
All risk of purchases becomes the buyer's as soon as the
animal is declared 'sold',
Johnstone Auction Mart Ltd. retains ownership of the
cattle until full settlement has been
made and cheques have cleared the bank. You may also
pay by debit card (check with
your bank to make sure your limit per transaction is high
enough) or credit card (2.5%
administration fee is added).

In the case of cattle which
are "safe in calf" according to the opinion of
the vet, there is
no further warrantee of the continuing pregnancy of the
cow/heifer. As anyone in the cattle
business is aware, many things can happen to cows to cause
them to abort the fetus,
including falls, bunting by other cattle, poor feed, etc.,
and finding a fetus from the first
or second trimester of pregnancy can be difficult, even in
a smaller corral - some times it
may just be absorbed by the cow and no evidence can be
found.

Physical Soundness:
Due to cost and time constraints, physical soundness exams
are rarely
done on cattle before auction. Please do your own
inspection of feet, legs, udder, etc.
before buying - bidding on the animals indicates you have
satisfied yourself as to all
aspects of the animal and no one else is responsible.

We represent the livestock as
they are represented to us regarding exposure, pregnancy,
training, etc.
by the seller and are not
responsible for
any inaccuracies. Johnstone Auction Mart Ltd. acts as an
agent only in the marketing of the livestock between buyer & seller, and any legal action
that may in
exceptional cases be taken, must
be taken between the buyer and seller themselves.

unpredictable and at times dangerous. Johnstone Auction
Mart Ltd. and staff assume no
responsibility in this matter, and disclaim any liability.
